Terms and Conditions

If you participate in The ESLI Surveillance Card Program (the "ESLI Card, The Program, Rewards, ESLI Certificates, & ESLI Dollars"), then you (purchaser, payor, user) accept the following Terms and Conditions:

1. Details & Restrictions:

 The ESLI Surveillance Card earns you 1 point for every net merchandise dollar spent. For every 500 points accumulated, 25 ESLI Dollars are issued as a ESLI reward certificate through your billing statement. Returns will result in a deduction of corresponding points accrued. ESLI certificates, are valid only in our ESLI Surveillance Online Web Store, and expire if they are not used by the printed expiration date, which is 60 days from the date of statement issuance. ESLI certificates may not be used to purchase gift cards, may not be used for adjustments to previous purchases and may not be combined with other rewards and discounts, including The ESLI Surveillance employee discount. ESLI certificates may not be redeemed for cash or cash equivalent.

The 10% first purchase discount may be used for one time purchase only, and applies to web store merchandise only, not applicable shipping and handling charges and taxes. First purchase discounts may not apply to some items, such as our custom built equipment. First purchase discounts may not be combined with other offers or discounts, including the ESLI Surveillance employee discount, and may not be redeemed for cash or cash equivalent. Returns and exchanges are subject to ESLI Surveillance's return policy.

2. Privacy:

 You agree that ESLI Surveillance may request proper identification with regard to ESLI Surveillance Rewards transactions . Federal law requires us to obtain, verify and record information that identifies each person who opens an account, in order to help the government fight the funding of terrorism and money laundering activities. To process the application, we must have your name, street address, date of birth and other identifying information, and we may ask for identifying documents from you as well. By accepting this Card, you agree that ESLI Surveillance may share information regarding your account, including name, address, phone number, email address, the account number and transaction information, for the purposes of providing customer service to you for the ESLI Card. In addition, you agree that ESLI Surveillance may use this information to send you select marketing and partner offers in accordance with the ESLI Surveillance privacy policy, which may be found at eyespyli.com/privacy. ESLI Card members shall be responsible for maintaining accurate and updated personal information according to the terms of the ESLI Card Agreement. ESLI Surveillance is not responsible for rewards that are not received as a result of a ESLI Card member's failure to update his or her personal information.

3. Eligibility:

This ESLI Card is open to U.S. residents ONLY at least 18 years of age enrolled with their ESLI Surveillance Card provided by ESLI Surveillance and is subject to credit approval. By joining the ESLI Card, you represent that you are at least 18 years of age or older and that you agree to the current and future terms and conditions of the ESLI Card. Membership in the ESLI Card is non-transferable.

4. Entire Agreement;

Governing Law & Arbitration: These Terms and Conditions constitute the entire agreement between ESLI Surveillance and the ESLI Card member, and replace any prior understandings or agreements (whether oral or written) regarding same. The ESLI Card shall be governed by and construed under the substantive laws of the state of New York, without reference to conflict-of-laws considerations. ESLI Surveillance and the ESLI Card member agree that any dispute, claim, or controversy arising from or relating to the ESLI Card or the member's ESLI Surveillance Card shall be resolved by binding arbitration conducted in the state of New York. ESLI Surveillance and the ESLI Card member acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim, or controversy, and understand that a judgment on any arbitral award may be entered in any court having jurisdiction. No arbitration pursuant to the ESLI Card shall be consolidated with any other arbitration.

5. Modification & Termination:

 We reserve the right to remove any person from the ESLI Card in the event of any fraud or abuse in connection with the ESLI Card. Your account must remain open and in good standing to receive any benefits offered under the ESLI Card. We reserve the right to change or terminate the ESLI Card, or any of its terms, conditions, details or restrictions, at any time and in any manner without notice. Some restrictions apply to employees of ESLI Surveillance.

6. 30, 60, 90 & 120 Days EasyPay Payments:

EasyPay makes shopping with us easer! EasyPay is a payment option that allows you to pay for purchases over a period of several months. Please note that the EasyPay option is subject to credit approval.
Choosing to use EasyPay option is easy and best of all zero interest accruing from ESLI. Your first monthly payment, plus applicable shipping and handling and tax, will be charged to your credit card when the item is shipped. Your next payment will be charged to your credit card monthly thereafter. No interest payments stretched over 30, 60, 90 & 120 days Late payment fees apply (see below). Payments terms are determined by credit history. Subject to credit approval. Selecting one of four payment options does not guarantee payout option. Several factors (credit history, credit score, etc.) influence which payment option you will receive.
 

7. NO WARRANTY:

 ESLI SURVEILLANCE AND ITS AFFILIATE ENTITIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS MAKE NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE MEMBERSHIP, APPROVAL, OR ANY PRODUCTS OR SERVICES RELATED THERETO.

8. RELEASE OF LIABILITY:

 ESLI CARD MEMBER HEREBY RELEASES ESLI SURVEILLANCE AND ITS AFFILIATE ENTITIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL LIABILITY RELATING TO MEMBER'S ESLI CARD MEMBERSHIP, APPROVAL, OR ITS TERMS.
